2. Subject of the Agreement

The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and provision of hot air balloon flight services ordered electronically by the Buyer through the Seller's website [www.cappadociaballoonticket.com] or other remote communication tools (telephone, WhatsApp, email, etc.) in accordance with the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.


3. Main Features of the Service

The type, scope, price, payment method, place, and date of performance of the purchased service are stated in the order confirmation and in this agreement.

Examples:

  • Cappadocia Hot Air Balloon Flight – Standard Flight – 23.09.2025 / 05:00 AM / 2 persons
  • Cappadocia Hot Air Balloon Flight – Deluxe Flight – 25.09.2025 / 05:30 AM / 4 persons
  • Hotel Pickup and Drop-off Service included

4. Payment Terms

  • The Buyer shall pay the service fee through one of the payment methods offered by the Seller (credit card, bank transfer, Stripe, PayPal, etc.).
  • The reservation shall only be confirmed once the full payment has been received.
  • After the payment is confirmed, the reservation details and pickup information will be sent to the Buyer electronically.
  • Payment processing may be handled by either our Turkish entity (EMK Seyahat Acentası Turizm Ltd. Şti.) or US entity (Xfergo LLC).

5. Performance of the Service

  • The hot air balloon flight service will be provided on the date and at the time specified in the reservation.
  • Hotel pickup service is included and will be arranged according to the customer's accommodation location.
  • The Seller is responsible for ensuring that the service is delivered safely, on time, and completely.
  • The Buyer is obliged to be ready at the hotel reception at the specified pickup time.
  • Flight duration is approximately 60 minutes (Standard) or 90 minutes (Deluxe), weather permitting.
  • A flight certificate and light breakfast/champagne celebration are included in the service.

6. Right of Withdrawal and Cancellation Conditions

According to Article 15 of the Law No. 6502, the right of withdrawal does not apply to contracts related to accommodation, transportation, catering, leisure, or recreational activities.

However, Cappadocia Balloon Ticket applies the following special cancellation and refund conditions in favor of customer satisfaction:

6.1 Hot Air Balloon Flight Cancellation by Customer

  • If canceled at least 24 hours before the scheduled flight time: Full refund (100%) will be provided.
  • If canceled less than 24 hours before the flight: No refund will be made.
  • No-show (customer does not show up): No refund will be made.

6.2 Flight Cancellation Due to Weather Conditions

  • If the flight is canceled by the balloon operator due to adverse weather conditions or safety concerns, the customer will receive:
  • Option 1: Full refund (100%), or
  • Option 2: Rescheduling to another available date at no additional cost.
  • Weather-related cancellations are determined by the Civil Aviation Authority and balloon operators for safety reasons.

6.3 Flight Cancellation Due to Force Majeure

  • In cases of force majeure (natural disasters, official bans, strikes, etc.), the customer will receive a full refund or the option to reschedule.

7. Health and Safety Requirements

  • Hot air balloon flights may not be suitable for:
  • Pregnant women
  • Children under 6 years old
  • Individuals with serious heart conditions, recent surgeries, or severe mobility issues
  • The Buyer is responsible for informing the Seller of any health conditions that may affect their ability to safely participate in the balloon flight.
  • The balloon operator reserves the right to refuse service if safety concerns arise.

8. Force Majeure

The parties shall not be held liable in case of force majeure such as natural disasters, strikes, wars, official bans, unforeseen technical failures, or adverse weather conditions. In such cases, the service will be rescheduled or the payment will be refunded.


9. Information and Acknowledgment

The Buyer declares that they have:

  • Read and accepted this agreement electronically
  • Received the preliminary information form regarding the hot air balloon flight service
  • Understood the health and safety requirements
  • Made the payment accordingly

10. Settlement of Disputes

For disputes arising from this agreement, within the monetary limits announced annually by the Ministry of Trade of the Republic of Turkey, Consumer Arbitration Committees or Consumer Courts located in the Buyer's place of residence are authorized.

For international customers, disputes may also be resolved through applicable international arbitration or the courts of Wyoming, USA, depending on the contracting entity.


11. Enforcement

The Buyer is deemed to have accepted all the terms of this agreement upon confirming the order. This agreement has been drawn up electronically and accepted by both parties.

Cancel 24+ hours before flight time for 100% refund, cancel less than 24 hours before flight for no refund, no-show or failure to be ready at pickup time results in no refund. Weather-related cancellations by the operator guarantee full refund or free rescheduling. Force majeure situations (natural disasters, official bans) result in full refund or rescheduling option.

Short Answer: Up to 5 years for legal compliance; marketing data until you unsubscribe.

Booking and transaction records are retained for 5 years to comply with Turkish tax law, US accounting regulations, insurance requirements, and legal obligations. Marketing consent data is stored until you withdraw consent via email or unsubscribe links. Website analytics and technical logs are kept for 12 months. Payment card details are never stored—handled entirely by payment processors.

Weather safety decisions are made by licensed pilots and aviation authorities, never by us.
